In no event will Long Island PC Techs, INC and LIPCTech.com, its subsidiaries, affiliates, and/or any subcontracted company hired by Long Island PC Techs, INC and its owner will be liable to you or any third-party or anyone affiliated to you, for any indirect, consequential, exemplary, incidental, special or punitive damages, whatsoever, even if Long Island PC Techs, INC and LIPCTech.com and/or affiliates and/or a subcontracted company hired by us have been advised of the possibility of such damages arising from any services offered to you the customer and/or any other general services offered whether paid by you and/or made free of charge as a courtesy of Long Island PC Techs, INC and LIPCTech.com and/or its owner. You agree that Long Island PC Techs INC and LIPCTech.com and/or its affiliates and/or any subcontracted company hired by Long Island PC Techs, INC will not be liable to you or to any third party as a result of any violation of these Terms of Use and license. The pick-up and delivery of computers or any equipment are completely free (exception may apply), only labor charges by the hour are applied unless a flat fee is discussed and established via an assessment and followed up via a contract, and only cash payments are accepted (exceptions may apply), for emergency cases an extra fee may be applied. We accept PayPal as well only for residential clients, for businesses, you need to refer to the subjective and/or individual contract presented to you. Sales taxes are to be collected on parts/accessories sold unless the equipment is offered to you for free and waived as a gift/courtesy. If for an unexpected reason you decide not to hand the computer or equipment to be repaired and/or call off the repair or contract (for businesses) at any time, a call fee will be billed to you to pay for travel time/expenses, and it is non-refundable. Other conditions might apply depending on the contract we set (for businesses).
If for any reason you interrupt the job or rush it, or call it off after the repair/diagnostic process has been initiated, you will be charged for the time spent besides the call fee above and any fees/costs as indicated in a contract if any (for businesses), as you did not let the repair and/or job to be completed and our warranty will not be applied; We reserve the right at any time to decline our services to you/your company and terminate a business relationship at our discretion and/or if you breach our terms, conditions and/or our contract without any prior notice. You acknowledge that we reserve the right at any time to decline our services to you/your company and terminate a business relationship at our discretion and/or if you breach our terms, conditions, and/or our contract without any prior notice. We also record all of our phone calls with you and all of our clients including emails, voicemails, texts, etc. for our reference, monitoring purposes, quality purposes, and to eliminate any possibility of misunderstandings as we take communication very seriously.
We retain the right to disclose any information that is required to be shared, disclosed, or made available to any governmental, administrative, regulatory, or judicial authority under any law or regulation applicable to the Company. We can further disclose your name, street address, city, state, zip code, country, phone number, email, as it in our sole discretion we believe it to be necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity.

FOR COMPUTER REPAIR: Our computer repair comes with a warranty on the labor (terms/timeframe of this warranty will be specified to you beforehand), and additional/further repairs will be performed to solve the issue if necessary within the terms of our warranty. Only in the exceptional case scenario where the motherboard and/or a related motherboard issue is discovered to be defective, you will be charged for the time spent diagnosing and troubleshooting your computer (max up to 3 hours) unless the motherboard was rendered useless and/or damaged by you and/or a third party tech in which case scenario you will be charged for the time spent fixing your computer with no limitations and the call fee above. You have a 48 hours warranty on the repair, during that time you can verify the effectiveness of the repair. If the symptom/issue should re-manifest itself within these 48 hours of warranty due to our service performance (up to now we are proud to say it has been unprecedented), you are guaranteed an extended labor warranty if additional repairs do not solve the issue (for residential clients and terms and timeframes will be specified to you beforehand); for businesses, however, you must follow the contract terms and conditions and any warranty specified within the contract and/or via email; if not specified, for businesses, the warranty is 3 business days). However, in these instances below the additional repair(s) will be billed and the labor warranty does not apply: 1. If a new issue/symptom should manifest itself during the warranty that was not reported to us and/or is independent of our repair; 2. If the same issue was repeated whether intentionally and/or accidentally. The hourly labor charges are non-refundable also if 3. We diagnose the computer and no repair is made due to: (a) We are unable to duplicate your issue; (b) The cost of labor and parts necessary to repair your computer will be of an amount close to the cost of a new computer or equipment of an undesirable amount in which case you withdraw your decision to repair the computer; 4. After we initiated our repair service, you choose not to proceed with re-installation of your operating system (worst case scenario), and/or you do not hand off the computer to us to perform the necessary repair steps to fix it, for acts of GOD and/or for any other reasons not mentioned here. You, the customer, guarantee, and state you are the owner of the computer(s), equipment to be repaired, and/or website(s) to be designed/setup whichever applies to your case; if you are not the owner, you state, guarantee and promise under the laws of the United States that you are acting on their behalf with their granted permission and you take full responsibility for the payment and the repair and/or any other job performed by the owner, Long Island PC Techs INC, LIPCTECH.COM. You also state you are 18 years old or over, if you are under 18 years old, you must inform us and you must have your guardians or parents, read, accept and sign these terms and this agreement instead on your behalf and take responsibility for the payment.
You agree to let Long Island PC Techs INC and LIPCTech.com and/or its subsidiaries and/or affiliates and their respective officers, agents, partners and employees, and/or any subcontracted company hired by Long Island PC Techs INC, accept and sign agreements online and offline and/or from cd’s, flash drives and/or any other media for the installation of various software and freeware for the purpose of diagnosis and/or repair and/or to accommodate your needs whether explicitly expressed or not by you the customer. For example, any third party software vendors (exceptions might apply) will be updated and/or downloaded or any other specific software and/or freeware and online agreements and disclosures will be electronically signed and agreed on your behalf whether or not you own the appropriate business and/or personal license and will remain your responsibility in all senses and not ours and not the responsibility of Long Island PC Techs INC and LIPCTech.com and/or its subsidiaries and/or affiliates and its respective officers, agents, partners and employees and/or any subcontracted company hired by Long Island PC Techs INC; our intent is to offer you the best possible service and set new standards for IT support, network engineering and computer repair services, and any other services offered even if not mentioned here! If your computer or any other type of equipment is under manufacturer’s warranty when the problem is diagnosed, I, the owner and Long Island PC Techs INC and LIPCTech.com and/or its employees, and/or any subcontracted company hired by Long Island PC Techs INC will proceed with the repair anyway as I or we assume you did not want to take advantage of the warranty service offered by the manufacturer, it is your responsibility to check whether your computer is under warranty and if you can take advantage of it. The length of the repair can only be approximated but in no way can be guaranteed and estimated due to the normal diagnostic, troubleshooting, and repair steps that need to be taken in order to finally repair an issue. The computer repair process is like an investigation, and a PC Tech and an IT or technician is to be considered like a troubleshooter; every case scenario is different, and sometimes many stages of troubleshooting and several repair steps are necessary to remove the culprit(s). Because of this nature, it is not possible to predict and/or offer a quote (for businesses, we assess first and then we offer you a quote). We might install open-source programs (free for personal and commercial use) on your computer that help us with the troubleshooting process, which might help us in the future to look at activity performed by you on your operating system like for example using Windows Event Log and similar. You will never be billed if we decide to use automatic scanners available online (and/or open-source) and these might be installed into your computer only out of courtesy for your future use only, not ours. HIPAA compliance is your sole responsibility unless we sign a BAA with your company. If we do sign a BAA with your company, we will make all the appropriate changes to your security as to be HIPAA compliant. If we do not sign a BAA with your company, we will not assume any responsibility for your HIPAA compliance. Failure to communicate with us can cause sudden termination of your website and no refunds are made. Any deposits are non-refundable as we put in a tremendous amount of work in setting up your website and we don’t take any other project besides yours, you will be our only priority! We work with you very closely to satisfy you 100% and we build the website based on your taste/preferences and also based on good marketing rules. The goal is to capture your visitors/customers and impress them and create an identity and a brand! This involves that we apply certain psychological elements while creating the layout and colors of your website. You as a client need to respect any deadlines we agree upon for example if you fail to offer feedback or make modification requests during any timeline that was set into an agreement, after the website has been completed, any requests that will follow that period, will not be accepted unless you purchase additional modifications and changes and if necessary.
Long Island PC Techs, INC. cannot guarantee the security of your website 100%. Ultimately your hosting company and WordPress will be responsible for any HIPAA compliance or security issues. If you cannot make it to the final appointment/deadline, you can reschedule the next day. However, the remaining balance needs to be remitted on the deadline as seen on any agreement set and can be remitted online via credit card or Paypal upon receiving from us an email with a payment link (no checks, no cash, only credit/debit cards or Paypal).
We reserve the right to login into your hosting account (Godaddy for example) and make any changes necessary to implement and build your website and for any modifications needed.

We ask you (the customer) to acknowledge any final terms/acknowledgments in which we mainly inform you of the risks involved in giving out these credentials to another hosting company (possible destruction of the website, viruses, etc. due to a third party hosting company negligence or incompetence) in the instance you decide to transfer your website from our hosting platform to another or for any other reasons. We do not hold a stranglehold on your website compared to other website design companies out there. We pride ourselves for a transparent service and we only ask that you accept/agree to any final terms/acknowledgments before credentials are given (credentials will be given to you no matter what), we only intend to make clear to you of any possible risks involved during the transfer and you (as the client) accept any and all responsibilities tied with the transfer process and whatever else happens after indicating the intention of cancellation (verbal, written). We reserve the right to terminate your website if payment is not remitted at completion on the deadline as seen on this agreement and/or if hosting fees are not remitted. Failure to renew hosting means deletion of the files, pictures, content, etc. You have 7 days before expiration to alert us that you wish to cancel the hosting (notice of intention of cancellation). After that, you will be given 15 days grace period to transfer and move your website to another platform of your choice and it is your responsibility to deal with that process. We are not transfer experts and we do not deal with transfer processes and we cannot help you with that. At our sole discretion and if we decide to offer you this courtesy, we might call you and email you to remind you of renewing the site. We shall not depend on your lateness, negligence, and failure to cooperate and respect any deadlines set by a contract and agreement made with you or anyone on your behalf. We cannot extend deadlines and we cannot make exceptions, this is our policy and terms. It only takes technically one day (2-6) hours to transfer a website and your new third-party hosting company can accomplish it all without any need of help from anyone. Propagation of the DNS can take longer but this does not affect the actual transfer of files, folders of the website. Our business schedule is extremely important to us. We cannot stress enough the importance of respecting these terms, appointments, and deadlines as we wish to make you our number one priority and complete the website in a timely manner and as per terms of this contract and any agreement set with you (the client).
